However, if Artful Eye sells assets (or the assets of a division or subsidiary) to another entity, or Artful Eye (or a division or subsidiary) is acquired by, or merged with, another entity, Artful Eye may provide to such entity customer information that is related to that part of our business that was sold to or merged with the other entity without your consent.

The Site contains links to other sites at which personal information is collected. In such instances, unless expressly provided to the contrary, the collection and use of your personal information will be governed by the privacy policy applicable to that site. That privacy policy should identify the entity that is collecting your personal information.

Collection of personal information

As a visitor to this Site, you can engage in many activities without providing any personal information. In connection with other activities, such as subscribing to the collaboration services offered on the Site or utilizing online software applications, Artful Eye may ask you to provide certain information about yourself by filling out and submitting an online form. It is completely optional for you to engage in these activities. If you elect to engage in these activities, however, Artful Eye may ask that you provide us personal information, such as your first and last name, mailing address (including ZIP code), e-mail address, telephone and facsimile numbers, and other personal information. When ordering products or services on the Site, you may be asked to provide a credit card number. Depending upon the activity, some of the information that we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity.

When you use the Site, Artful Eye or third parties authorized by Artful Eye may also collect certain technical and routing information about your computer to facilitate your use of the Site and its services. For example, we may log environmental variables, such as browser type, operating system, CPU speed, and the Internet Protocol ("IP") address of your computer. We use these environmental variables to facilitate and track your use of the Site and its services. Artful Eye also uses such environmental variables to measure traffic patterns on the Site. Without expressly informing you in each particular circumstance, we do not match such information with any of your personal information.

When you submit personal information to Artful Eye through this Site, you understand and agree that this information may be transferred across national boundaries and may be stored and processed in any of the countries in which Artful Eye and its affiliates and subsidiaries maintain offices, including, without limitation, Canada. You also acknowledge that in certain countries or with respect to certain activities, the collection, transferring, storage, and processing of your information may be undertaken by trusted vendors of Artful Eye. Such vendors are bound by contract not to use your personal information for their own purposes or provide it to any third parties. One instance where this could occur is in conjunction with framed pages in which the URL for the pages is not visible and the pages are being hosted by a vendor of Artful Eye.

Artful Eye has established relationships with various service providers whose services are available to you from this Site or from Web sites that are linked to this Site. Typically, these providers offer services that Artful Eye customers might find useful, such as those that can be used in conjunction with The Decal Zone services and products. In order to use those services, you may be required to provide personal information to the providers. Unless expressly provided to the contrary, personal information that you provide while you are visiting a provider's Web site will be subject to the privacy policy posted on such site, and personal information that you provide while on this Site in conjunction with a provider's service will be subject to this Privacy Policy. How your personal information is used

Artful Eye collects your information in order to record and support your participation in the activities you select. If you subscribe to a service or register a product, for example, the information is used to register your rights, if any, to technical support or other benefits that may be made available to registered users. As another example, if you enter a contest, information is collected to qualify the entry and contact you regarding the contest or prize awards. Your personal information is also used to keep you informed about product updates, special offers, and other products and services of Artful Eye and selected third parties if you have so opted to receive such communications.

Artful Eye may collect information about the use of the Site, such as the types of services used and how many users we receive daily. This information is collected in aggregate form, without identifying any user individually. Artful Eye may use this aggregate, non-identifying statistical data for statistical analysis, marketing, or similar promotional purposes.

Your choices with respect to personal information

Artful Eye recognizes and appreciates the importance of responsible use of information collected on this Site. Without your consent, Artful Eye will not communicate any information to you regarding products, services, and special offers available from Artful Eye, although we may find it necessary to communicate with you regarding your use of the services on this Site. Protection of your personal information

The personal information that you provide in connection with registering yourself as a user of Artful Eye products or services or registering an Artful Eye product is classified as Registration Information. Registration Information is protected in several ways. Access by you to your Registration Information is available through a password and unique customer ID selected by you. This password is encrypted. We recommend that you do not divulge your password to anyone. In addition, your Registration Information resides on a secure server that only selected Artful Eye personnel and contractors have access to via password. Artful Eye encrypts your personal information and thereby strives to prevent unauthorized parties from viewing such information when it is transmitted to Artful Eye.

Personal information that you provide that does not constitute Registration Information also resides on a secure server and is only accessible to selected Artful Eye personnel and contractors via password. Since this information is not accessible by you, you will not be asked to select a password in order to view or modify such information.

Use of cookies

When you visit this Site, you can browse the Site and access important information without revealing your identity. In order to improve our Site, we use "cookies" to track your visit. A cookie is a small amount of data that is transferred to your browser by a Web server and can only be read by the server that gave it to you. It functions as your identification card, and enables Artful Eye to record your passwords, purchases, and preferences. It cannot be executed as code or deliver viruses.

While Artful Eye uses cookies to track your visit to godecalzone.com, and our Web servers automatically log the IP/Internet address of your computer, Artful Eye does not generally use this information to identify you personally. However, if you expressly provide consent for godecalzone.com to "remember" the unique identifier that you select when you register for various activities on the site, that unique identifier will be stored on a cookie on your computer, linked to your registration information, and your navigation path around the site will be tracked. We associate this data to understand how our site and services are being used so we can understand our customers and offer appropriate products and services.

Please note that if you provide Artful Eye with inconsistent privacy preferences (for example, by indicating on one occasion that third parties may contact you with marketing offers and indicating on another occasion that they may not), Artful Eye cannot guarantee that your most recent privacy preference will be honored.

DATA POLICY

When you use Artful Eye, we must process information about you. The types of information we collect depend on how you use Artful Eye.

We realise that people are unsure about entering their personal details into websites via the Internet. Below, we explain what information we collect from you, how we use and process your information, who we transfer it to etc.

When this policy mentions “Artful Eye” “we,” “us,” or “our,” it refers to Artful Eye Creative, the company that is responsible for your information under this Data Policy (the “Data Controller”).

A) WHAT KINDS OF INFORMATION DO WE COLLECT?

We collect the content, communications and other information you provide when you use Artful Eye, including when you sign up for an account, subscribe to our newsletter, make a comment, update your user profile, create or share content, and message or communicate with others. This can include information in or about the content you provide (like metadata), such as the location of a photo, the date of sign-up, or the date a file was created.

• When you sign up as a user

When you manually sign-up as a user on Artful Eye we collect the following information from you: first name, last name, email address, telephone number, company name (if applicable) and your address which includes the name of your city, country you reside and zip/postal code.

When you sign-in via Facebook we collect your data from your public profile, including your name, profile photo, email address, nationality and other information provided by Facebook.

When you sign-in via Google+ we collect data from your Google+ profile, including your name, profile photo, email address, nationality and other information provided by Google+.

• When you make a purchase

For us to process an order for you, we collect some information from you. The information required may vary per item chosen, depending on which design you wish to purchase, as it ultimately depends on what information our production department requires to produce our product for you.

We always require your title, full name, email address, billing/shipping address, and your contact number. For certain Products that you purchase we may also require additional details in order to produce the product.

In order to confirm purchase of a Product on the website Artful Eye also require your credit or debit card details and perhaps other financial details. Please note that we only store 4 of the 16 digits of your credit card for security reasons. The remaining information is passed on to Shopify, PayPal or PSIGate, who are the international and accredited payment gateway providers. We furthermore collect information about the Product purchase and transaction, including meta data such as IP location, time of making the purchase and other information.

• Messaging with users

When you communicate with Artful Eye or use the Artful Eye messaging service to communicate with other users, we collect information about your communication and any information you choose to provide, including meta data. In such messages you could in theory provide information about your religious views, political views, or your health. This and other information (such as racial or ethnic origin, philosophical beliefs or trade union membership) could be subject to special protections under the laws of your country.

• When you provide details for e-newsletters or similar

When you subscribe to our newsletter, or download any articles via email or similiar, we will collect and store your email address.

• Your usage

We collect information about how you use the Artful Eye, such as the types of content you view or engage with; the features you use; the actions you take; the suppliers or users you interact with; and the time, frequency and duration of your activities. For example, we log when you're using and have last used Artful Eye, and what products, pages, and other content you view on Artful Eye.

• Things others do and information they provide about you

We also receive and analyze content, communications and information that other people provide when they use Artful Eye. This can include information about you, such as when others send a message to you.

• Device Information

As described below, we collect information from and about the computers, phones, connected TVs and other web-connected devices you use that integrate with Artful Eye, and we combine this information across different devices you use.

Information we obtain from these devices includes:

• Device attributes: information such as the operating system, hardware and software versions, and browser type.

• Device operations: information about operations and behaviors performed on the device, e.g. mouse movements (which can help distinguish humans from bots).

• Identifiers: unique identifiers, device IDs, and other identifiers, associated with the same device or account. 

• Network and connections: information such as the name of your mobile operator or ISP, language, time zone, and IP address.  

• Cookie data: data from cookies stored on your device, including cookie IDs and settings

B) HOW DO WE USE THIS INFORMATION?

We use the information we have (subject to choices you make) as described below and to provide and support the growth of Artful Eye. Here’s how:

• Provide, personalise, measure and improve Artful Eye: We use the information we have to deliver our Products, including to measure and personalize features and content (including your product choices, currency and activity display) and make suggestions for you (such as Products you may be interested in or topics you may want to follow, etc.) To create personalized Products that are unique and relevant to you, we use your past browsing data on Artful Eye; how you use and interact with our Products, companies, and users; and your geographical location.

• Location-related information: We use your current location (via IP address) to show you Product information in your local currency, including showing you relevant Products.

• Product research and development: We use the information we have to develop, test and improve Artful Eye and its existing features, including by conducting surveys and research, and testing and troubleshooting new products and features. We also use your information to share with other users on e.g. how many users are currently active in the Product you’re looking at, or if a user has recently purchased a Product in a given region.

• Provide measurement and analytics: We use the information we have to understand the usage of Artful Eye better, to know how many people use it, and how they use it.

• Promote safety, integrity and security: We use the information we have to verify accounts and activity, combat harmful conduct, detect and prevent spam and other bad user experiences, maintain the integrity of Artful Eye, its Products, and data, and promote safety and security on Artful Eye, and for all the data we collect. 

• Marketing and Communication with you: We use the information we have to send you marketing communications, communicate with you about Artful Eye, our Products, about a conversation you’re having with a supplier, and let you know about our policies and terms of use. We also use your information to respond to you when you contact us, to assist you better with an existing or upcoming purchase.  

C) HOW IS THE INFORMATION SHARED?

Upfront, we DO NOT sell any of your information to anyone. Your information is shared with other parties in the following ways:

• Suppliers of Products:

We are required to communicate and share your information to the supplier with which you purchased a Product so that the supplier knows your required purchase information and when you will be starting your Product. We give your name, your nationality, your phone number, your email address, and other information provided, including all the information entered into the purchase form, when making a purchase, and other information collected post-purchasing, to the supplier. The supplier requires this information to process your purchase. The supplier and other users will furthermore receive all the information that you pass to them via our messages system inside Artful Eye. All suppliers on whose behalf we facilitate purchases of Products have agreed to the Artful Eye terms and conditions and accepted this Artful Eye Data Policy.

• People and Suppliers that you share and communicate with:

The users and suppliers who you communicate with will receive all the information shared and communicated. In order to help and assist you, we furthermore share all this information with a few select Artful Eye staff so that they can assist you better with your communication, existing or upcoming Product purchases. When you make an enquiry via Artful Eye and respond back to e.g. a supplier via email, this information still goes through Artful Eye and is shared with the supplier, via the Artful Eye, as well as the few select Artful Eye staff.  

• Public information:

Public information on Artful Eye can in principle be seen by everybody, including if other people don’t have an account in Artful Eye. This includes comments you make in our forums, comments to an article or blog post. We may furthermore share questions or concerns that you raised with Artful Eye’s Customer Service, and provide an answer to such questions publicly, to better assist other users of Artful Eye.

• Content others share or reshare about a page on which you’ve contributed some content:

When you post a comment, make a review, upload an image, or in any other way make some information publicly available on Artful Eye, such information may be shared via Artful Eye or other channels by other users.

Information about your active status:

When you’re logged in and on Artful Eye other people will be able to see signals telling them that you’re active, or when you last used Artful Eye, when they check your profile.

Apps, websites, and third-party integrations on or using Artful Eye:

When you do a login with Facebook or Google+, they will know that you logged into Artful Eye, so this information is shared with Facebook and Google. Same applies if you do a social media share or like with a social media channel such as e.g. Facebook, Google+ or another third party platform.

New owner:

If the ownership or control of all or part of Artful Eye changes, we may transfer the information to the new owner.

Sharing with Third-Party Partners:

We share analytics and browsing data with third parties such as Google, Facebook, Instagram, Twitter, and other third parties for marketing and analytics purposes, including improving Artful Eye as a product. Most of this data is, however, only accessible on an aggregate manner.

Our auditors and other people may have access to some of your purchasing data, but merely from a legal perspective, e.g. when we’re having our accounts audited by an accredited auditor company.

Vendors and service providers:

We provide information and content to vendors and service providers who support our business, such as by providing technical infrastructure services, analyzing how our Products are used, providing customer service, facilitating payments or conducting surveys.

Law enforcement or legal requests:

We share information with law enforcement or in response to legal requests.

D) WHAT IS OUR LEGAL BASIS FOR PROCESSING THE DATA?

We collect, use and share the data that we have in the ways described above:

• consistent with your consent, which you may revoke at any time through the Artful Eye profile page;

• as necessary to comply with our legal obligations;

• as necessary for our (or others') legitimate interests, including our interests in providing an innovative, personalized, safe, and profitable design service to our users and partners, unless those interests are overridden by your interests or fundamental rights and freedoms that require protection of personal data.

E) HOW CAN YOU EXERCISE YOUR RIGHTS PROVIDED UNDER GDPR?

Under the General Data Protection Regulation, you have the right to access, edit, rectify, port and delete your data. You will be able to do such under your Artful Eye profile page.

F) DATA RETENTION, ACCOUNT DEACTIVATION, AND DELETION

We store data until it is no longer necessary to provide our services and Artful Eye as a product.

This is a case-by-case determination that depends on things like the nature of the data, why it is collected and processed, and relevant legal or operational retention needs.

For all files submitted via Artful Eye’s message system, we will delete any file with a storage time of 24 months or more.

If you decide to close your Artful Eye account from your Artful Eye profile page, we will deactivate your account and delete all your profile information. Please note, however, that we in our files may retain some information associated with your account and past transactions for purposes including backups, fraud prevention, dispute resolution, investigations, and compliance with legal requirements.

As a registered Artful Eye user, you can modify your email subscription choices at any time on the Artful Eye profile page. Please note, however, that we reserve the right to send you other communications, including service announcements, administrative messages, and surveys relating to your Artful Eye account, without offering you the opportunity to opt out of receiving them.

G) HOW DO WE RESPOND TO LEGAL REQUESTS OR PREVENT HARM?

We want you to feel confident about using Artful Eye, and we are committed to protecting the information we collect. While no website can guarantee security, we have implemented appropriate administrative, technical, and physical security procedures to help protect the personal information you provide to us. For example, only authorized employees are permitted to access personal information, and they only may do so for permitted business functions. In addition, we use encryption when transmitting your personal information between your system and ours, and between our system and those of the parties with whom we share sensitive information, and we employ firewalls and intrusion detection systems to help prevent unauthorized persons from gaining access to your information.

You should be aware that where you link to another website from this website, that Artful Eye has no control over that other website. Accordingly, Artful Eye cannot guarantee that the controller of that website will respect your privacy in the same manner as Artful Eye.

We access, preserve and share your information with regulators, law enforcement or others:

• In response to a legal request, if we have a good-faith belief that the law requires us to do so. We can also respond to legal requests when we have a good-faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards.
  
  
• When we have a good-faith belief it is necessary to: detect, prevent and address fraud, unauthorized use of the Products, violations of our terms or policies, or other harmful or illegal activity; to protect ourselves (including our rights, property or Products), you or others, including as part of investigations or regulatory inquiries; or to prevent death or imminent bodily harm. For example, if relevant, we provide information to and receive information from third-party partners about the reliability of your account to prevent fraud, abuse and other harmful activity on and off Artful Eye.

Artful Eye is a general audience site and does not offer services directed to children. Should an individual whom we know to be a child under age 13 send personal information to us, we will delete or destroy such information as soon as reasonably possible. People below 18 years old will not be able to make a product purchase.

H) HOW DO WE OPERATE AND TRANSFER DATA AS PART OF OUR GLOBAL SERVICES?

We share internally within the Artful Eye Creative Companies and externally with our partners and with those you chat and message with around the world in accordance with this policy. Information controlled by Artful Eye will be transferred or transmitted to, or stored and processed in Canada or other countries outside of where you live for the purposes as described in this policy.
